Terms & Conditions

Terms & Conditions regulate the use of AbleTrace OÜ, registry code 12620854, address Raja tn 15, Tallinn, 12618 („Safely“) services on the web platform www.safely.ee („Service“). By registering as a user of the Service, you agree to these Terms & Conditions and confirm that you are at least 18 years of age. If you do not agree to the Terms & Conditions, you are not entitled to use the Service.

1. Service

Safely provides a reliable web-based platform for property management available on www.safely.ee („Website”). This includes document management, inventory management, tenant screening and creation and completion of service tasks.

2. Users

The platform is used by landlords, tenants, real estate agents and property managers. Landlords will be able to conduct tenant screenings (see also Privacy Policy), manage, create leases and tasks. Landlords will have access to the information that tenants have disclosed to them. Property managers can create tasks, manage documents and inventory.

The users of the Service can publish their rental requests on the platform and indicate the conditions under which they wish to rent the property.

Users authorize Safely, directly or through third parties, to make any inquiries we consider necessary to validate your identity. This may include asking you for further information, requiring you to take steps to confirm ownership of your email address or verifying your information against third party databases or through other sources. Nothing herein shall be construed to require Safely to verify the identity of any User on the Website nor will Safely have any liability for failure to verify any User's identity.

3. Tenant screening

The tenant screening process can be started by the property owner. The tenant's consent is required to perform tenant screening. Tenant fills the tenant form with the necessary personal data (See also Privacy Policy). Landlords have access to the information disclosed to the my tenants. Safely processes the information provided by the tenant to compile a report on the results of the tenant screening, to calculate the solvency, fit for contract and general score.

Safely also uses third party, Krediidiregister OÜ ("Taust.ee") for tenant screening. In tenant screening report Safely uses payment default and dept information provided by Taust.ee. Before starting the tenant screening process property owner must make sure they have a legal right for the request, that may be property owners legitimate interest in renting out their property.

By agreeing to the tenant screening, the lessee gives the property owner the consent and thus the legal basis for making the Taust.ee request.

4. Lease generation

Safely does not provide any legal counselling or advice, but only offers a text generator service. The lease will be concluded between the property owner and the tenant. Safely is not a party of the tenancy agreement and is not responsible for any acts or omissions of the property owner or tenant. Before signing a contract, you should seek legal counsel by consulting with an attorney. Safely does not guarantee that the property owner will find a suitable tenant while using the Service. Nor does Safely make any promises that the tenant will be able to find a suitable rental property. Safely offers contract generation based on property owner, tenant, and leased object, but is in no way involved in the contract.

5. Tasks

Users can create tasks for other users in the system (for example tenants) or 3rd party users. Tenants, landlord and property managers who are paying users may use phone support for urgent issues. Safely will find solution for the problem by contacting required contractors based on the type of maintenance issue and the location of the unit.

6. Property management tools

Users can create assets and manage roles who may or may not have access to any asset information. Safely does not take any responsibility for the misuse of given tools and for providing access to wrong individuals who may use provided asset information maliciously.

7. User account

The user is responsible for the use of a user account. User is obliged immediately inform Safely about misuse or suspicion of misuse of the account.

The user is not allowed to transfer files that contain viruses or malicious software code through the Service.

The user must not provide false information to the Service. Safely does not check the accuracy of the data provided and is not responsible for any incorrect data.

Users may cancel the use of the Service at any time effective immediately by contacting us at safely@safely.ee. You will remain liable for all outstanding payments and fees due at the time of cancellation. If you request, Safely will delete your User account, but this request will only delete your personal account and not information that relates to you that is on another User's account (for instance, a signed lease to which you are a party).

Safely may suspend the right to use the Service if the user violates the Terms & Conditions or if Safely believes that the user has acted unfairly towards other users or Safely.

8. Cost of service and payment

The user has the possibility to use Safely.ee platform for 7 days free of charge. After 7 days trial has passed, the user is required to choose a subscription plan according to their needs. The user account is no longer usable when the trial period has passed and subscription plan is not selected.

The user will be charged a monthly subscription fee for the subscription plan he or she selects for use of the services. The pricing table for Safely.ee can be seen on the landing page and is divided into subscription types: Residential, Commercial, Asset management. The price paid will be clearly displayed to the user before he or she selects the subscription plan. The monthly Invoice amount will be depending on the amount of properties managed. and subscription plan selected. The subscription fee will be due monthly on the day of the month user started using the service.

The payment for subscription plan can be done through following bank links: Swedbank, SEB, Luminor, LHV or Coop Pank. Payment intermediary is Maksekeskus AS.

Safely may change the pricing of the service at any given time by announcing this on the Safely.ee website. The paid service cannot be terminated. The paid subscription fee will not be refunded. The prices of subscriptions types on Safely.ee website are displayed in Euros.

9. Links for the Website

Third-party links are used on the Safely webpage to display additional information. Safely is not responsible for the security or content of any of the links mentioned, as they are not under the control of Safely. The user is solely responsible for the use of links and the processing of the information contained therein.

10. Intellectual property

Platform trademarks, logos, software, copyrights, domainname are intellectual property of Safely. Safely does not grant users any rights to use the intellectual property rights except to the extent necessary to use the Services.

You may not copy or make available to the public the content of the Service without Safely's consent.

The platform collects data about landlords and tenants. Within the meaning of copyright law, this is a database which is exclusively owned by Safely. By accessing the platform, users will only have the right to use the database to the extent necessary to access the Service through the platform.

11. Technical conditions

Safely goal is to provide users with the best quality and security of the Service, but Safely cannot guarantee that the Service will be uninterrupted, timely or error free at all times.

Safely shall not be liable for any technical impediments while using the Service or for any damages arising therefrom, including damages as a result of any act or omission of web hosting, internet service provider or any other service provider.

12. Liability

Safely is not responsible for:

  • the accuracy of the information provided by the landlord and the tenant;
  • the accuracy of the data contained in third-party public databases;
  • the solvency and payment discipline of the tenant;
  • the performance of the lease;
  • damages caused during the performance of the lease;
  • any loss incurred by the landlord or tenant while using the Service;
  • retaining files stored on the platform;
  • misuse of members and roles feature;
  • technical errors, defects and interruptions on the platform. Such circumstances shall not be considered a violation of the terms of use.

Safely shall not be liable for any loss or damage sustained by a user as a result of use, inability to use, interruption, data changes, destruction or deletion of the Service, if such event occurred for reasons beyond Safely's control. Safely shall not be liable for any indirect damages, including lost profits, to the user.

The user is aware that Safely shall not be liable for any breach of contract between the landlord and the tenant or for any damage caused to the landlord by the tenant. Safely shall not be liable for any damage or loss of the property owner's property.

IN NO EVENT WILL SAFELY, ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE WEBSITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE WEBSITE OR SUCH OTHER WEBSITES OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE.

13. Privacy Statement

Protecting your privacy is very important to us. Please review our Privacy policy in order to better understand our commitment to maintaining your privacy, as well as our use and disclosure of your information.

If you receive information about another User through the Services, you must keep the information confidential and only use it in connection with the Services. You may not disclose or distribute a User's information to a third party or use the information for marketing purposes unless you receive the User's express consent to do so.

14. Indemnification

You agree to defend, indemnify and hold harmless Safely, its affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms & Conditions or your use of the Website, including, but not limited to, any User information you provide on the Website or Services, any use of the Website's content, Services and products other than as expressly authorized in these Terms & Conditions or your use of any information obtained from the Website.

15. Other

Users acknowledge that Safely does not verify the identity or accuracy of any User or any information User supplies on the Services or Website. Any other information presented on or through the Website, including, but not limited to material presented on our blog, information in Rent Roll Reports or any other reports is made available solely for general information purposes. We do not warrant the accuracy, completeness or usefulness of the User information or any other information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Website, or by anyone who may be informed of any of its contents.

Safely may suspend your right to use the Service if you violate these Terms & Conditions. If Safely restricts your right to use the Service, Safely will not be liable for any loss or expense which may incur.

Safely may change the Terms & Conditions at any time upon 14 days' notice. If the user does not agree to the new Terms & Conditions, they must delete their user account. If the user does not delete the account, they will be deemed to have accepted the new Terms & Conditions. Technical specifications or the addition of new services shall not be considered as changes to the Terms & Conditions.

The service description and price list are published on the online platform. The service can be paid in Euros via the online platform using payment solutions. Paid services can be used after making payments.

The duration and terms of use of the service are stated on the Safely platform. The paid service can be used after payment of the service fee. The paid Service cannot be terminated. The paid service fee will not be refunded or reduced.

The Terms & Conditions shall be governed by the law of the Republic of Estonia. Disputes will be resolved by negotiation and, if unsuccessful, will be settled in Tartu County Court.

If any provisions of these Terms & Conditions turn out to be invalid in whole or in part, this shall not affect the validity of the remaining part of a given provision or other provisions

Storing personal data

  • The data will be stored for the duration of the Safely.ee platform user account.
  • Upon deletion of Safely user account, we keep transactional and contract data for 10 years.
  • Once this time period has expired, we will be deleting your database entries and files.


Your rights

As a data subject, You have the following rights:

  • You have the right to request that we correct any inaccurate information or complete the information you believe is incomplete.
  • You have the right to request that we erase your personal data, under certain conditions.
